Grade Crossing Litigation

(Rescheduled from March 29, 2023)

"Grade crossing litigation" arises after a collision between a train (or some other kind of on-track railroad equipment) and a vehicle at a highway-railroad grade crossing. Grade crossing litigation is unique and carries with it interesting issues of fact investigation, discovery, and legal implication. This presentation will address the nature of grade crossing litigation, the railroad's duty at crossings, the motorist's duty at crossings, and preemption issues.


Lyn Robbins, Esq.


Lyn Robbins is President and Co-Owner of Robbins Travis PLLC in Southlake, Texas, where he practices law, focusing on railroad litigation. Prior to forming this firm with Susan Travis, Lyn was from 2003 through end of 2015 senior general attorney for BNSF personal injury claims litigation, major damage collection litigation, and appellate matters, with additional responsibility for commercial dispute resolution, arbitration, and some employment issues. From 1990-2003, he practiced with Gullett, Sanford, Robinson & Martin, PLLC in Nashville, Tennessee, litigating hundreds of cases, trying more than forty cases to verdict, and handling dozens of appeals with multiple arguments before both state and federal appellate courts and briefing before the United States Supreme Court.

 From 2006-2019, he was an adjunct professor of law at Baylor School of Law, teaching both Basic and Advanced Trial Advocacy Skills. He has taught at the National Association of Railroad Trial Counsel's College of Trial Advocacy since its inception in 2008. He is a frequent speaker at Continuing Legal Education presentations around the country.

He received his J.D., cum laude, 1990 from Baylor School of Law, Waco, Texas, where he was a Leon Jaworski Scholar and the Lead Articles Editor of the Baylor Law Review.
